Why didn’t you shoot em? PT1

Often I am asked the question: " So when can I shoot someone?" Within the context of self -defense, it is a honest question but none the less it always makes me a little uncomfortable. I never tell anyone that “ if ABC happens then you can shoot. I do give situations where I might, key word might; use deadly force. I Assure them that even if detective Stevie Wonder was in charge of the investigation it would be clear that there was no viable alternative than deadly force if I were to have been involved in a self-defense shooting. On Dec 6th of this year my father in-law was in his own home on his 70th Birthday minding his own business when he heard a loud crashing sound. He at first thought it was something in the kitchen that had recently been put up. Yet the noise had not come from that area. He decided he had best get his gun which was nearby.

Taking a tactical position he observed a man stepping trough the now shattered patio glass door. As the man stepped in he looked up only to find dad pointing a gun right at his chest. Before anything could be said, the man exited back the way he came albeit considerably faster. No shots were fired.

As news spread of the event, many relatives expressed the view that he “ should have shot him” Even the police who responded, while not voicing that position directly, did at least allude to as much indirectly.

Generally in Florida and other southern states, home invasion is seriously frowned upon. VERY seriously frowned upon. When I spoke to my father in-law I told him that I felt that he did the right thing. He felt bad that he had been put in the situation of possibility of having to take a human life. In real life, even when you shoot someone in self-defense it is still going to be disruptive to your life. It’s not like TV or the movies. Questions have to be answered and the answers better be the correct ones. It was Ironic that the man had one foot in and one foot out as he was coming in the house. I say that because it was a few weeks before this that a client asked me if it was ok to shoot in such a scenario. To my father in-laws credit, he has a strong moral compass.
He did not depend on the possible blessing of the court system or law enforcement to decide if he should pull the trigger.

The question is not "why didn’t he shoot?" The question is: what is the level of force that I need here and now to survive this deadly encounter? I have no doubt what so ever, that had this individual continued moving forward, the outcome would have been fatal or near fatal for the would be home invader. But to answer the question as to “why didn’t shoot you em?” That‘s easy; because he did not have too. Remember that!!!!
